Protected Disclosures

Independent support for secure, compliant whistleblowing procedures

At Friel Stafford, we support organisations and individuals in managing protected disclosures with professionalism, discretion, and full legal compliance. Under the Protected Disclosures Act 2014, as amended in 2022, workers in both public and private sector organisations are legally protected when they report concerns relating to wrongdoing in the workplace.

We help companies establish robust internal procedures, and we act as independent recipients of disclosures where neutrality and confidentiality are essential.

What is a protected disclosure?

A protected disclosure (commonly known as whistleblowing) involves a worker reporting information that they believe shows wrongdoing, such as:

  • Financial misconduct or fraud
  • Breach of legal or regulatory obligations
  • Health and safety risks to individuals
  • Environmental harm or damage
  • Abuse of authority or unethical behaviour
  • Concealment or destruction of evidence related to any of the above

Disclosures made in good faith are legally protected, and workers must not suffer penalisation or retaliation as a result.

Our Services Include:

  • Acting as an independent designated recipient for disclosures
  • Reviewing and assessing the validity and risk of reported concerns
  • Advising companies on internal processes and best practice procedures
  • Supporting organisations in investigating disclosures appropriately
  • Ensuring compliance with EU and Irish legislative requirements

We also assist businesses in ensuring they meet the requirements for internal reporting systems if they employ more than 50 staff or fall under sector-specific obligations.
